Client Release

I desire to receive Fireside Project-Certified Coaching (“Coaching”) offered by Fireside Project, Inc. (“Fireside”), a Delaware nonprofit corporation. In consideration for the compensation and other benefits received through the Coaching, and in recognition of the Fireside’s reliance hereon, I agree to all the terms and conditions set forth herein and agree to Fireside’s Terms of Service, as incorporated herein by reference.

1. I understand that Fireside offers the Coaching solely to provide emotional support to those who have already made the decision to have a future psychedelic experience; or who have already had a psychedelic experience in the past. I agree to pay all fees for the Coaching.

2. By offering or providing the Coaching, I understand and agree that Fireside is not encouraging, recommending, instigating, inciting, criminally facilitating, soliciting, or promoting any illegal activity or using of or facilitating the procurement of or procuring any substance(s) on my behalf or otherwise. I understand that certain substances are illegal under state and federal laws, and it is my responsibility to be informed about the legal status of any substance I use for a psychedelic experience. In the event Fireside directs me to educational information from a third-party, I understand and agree that such direction does not constitute encouraging, recommending, instigating, inciting, criminally facilitating, soliciting, or promoting any illegal activity or using of or facilitating a psychedelic experience, and that such information is given or provided solely for educational purposes. I further understand and agree that Fireside does not guarantee or warrant the accuracy or completeness of any such information, and Fireside is not responsible or liable for any loss or damages resulting from my use of or reliance on any such information.

3. I represent and warrant that Fireside has not and shall not help me decide as to whether to engage in a psychedelic experience, which psychedelic substance to take or at what dose, where to go for a psychedelic experience, what psychedelic experience to have, or any other related decisions. I affirmatively state and agree that any and all such decisions to engage in a psychedelic experience shall be made solely by me, for my own behalf, with or without Fireside’s provision of the Coaching. I understand and acknowledge that there are known and unknown, foreseeable and unforeseeable, risks directly or indirectly associated with engaging in a psychedelic experience, including but not limited to the risks of serious injury, disability, death, and/or property damages, as well as other forms of damages, losses, or personal injury, such as pain, suffering, mental health or emotional distress (collectively, the “Risks”). I understand and agree that the Risks involved in engaging in a psychedelic experience may not be fully mitigated by the support or information received through the Coaching. Notwithstanding the foregoing Risks, I agree to accept and assume any and all Risks arising out of my own decision to engage in a psychedelic experience.

4. I understand and acknowledge that while it is a requirement for me to sign this agreement to receive the Coaching, Fireside does not require that I engage in a psychedelic experience to receive the Coaching.

5. I understand and acknowledge that the Coaching is not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. I also understand that Fireside is not acting as a mental health counselor, therapist, or a medical professional.

6. I represent and warrant that all information, including, without limitation, medical and mental health history, I provide to Fireside is accurate and complete and I acknowledge and understand that Fireside is relying on such information to assess my compatibility to work with Fireside or receive the Coaching.

7. I understand that Fireside will protect my information as confidential unless I state otherwise in writing. To the extent required by law or court order, I understand my confidentiality agreement may be limited in certain circumstances, such as threatening harm to myself or someone else, and that necessary actions will be taken in such circumstances.

8. I hereby release, waive, acquit and forever discharge Fireside, its directors, officers, agents, successors, assigns, representatives, employees and contractors (the “Releasees”) from any and all claim, suit, action, damages, demand or right to compensation for damages I, my assignees, heirs, representatives and executors, now have, or may have in the future, for injury, death or property damage, related to, in connection with or arising out of (i) my use of the Coaching; and (ii) the negligence or other acts or omissions, whether directly or indirectly in connection with or resulting from the Coaching, and however caused by the Releasees or otherwise. This waiver and release do not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be released by agreement. With the intention of waiving all unknown and unsuspected claims, I hereby expressly waive all rights, benefits and protections I may have under California Civil Code Section 1254, which reads, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

9. I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents.

10. Some individuals may not be a fit for our program due to certain psychiatric diagnoses or the diagnoses of individuals in their family. With that, I understand that I am not eligible for Fireside-Certified Psychedelic Coaching if myself, my parents, my siblings, or my children have any of the following diagnoses: mood disorder with mania or hypomania (i.e. Bipolar I or II, cyclothymia), mood disorder with psychotic features, Schizophrenia, Schizoaffective disorder, Schizotypal disorder, Substance-induced psychotic disorder, or Postpartum psychosis.

By checking the box that indicates “I agree to the Client Release” on the Fireside Project-Certified Psychedelic Coaching checkout page, I represent that I am an adult age 18 or older and legally competent. I acknowledge that I have read and fully understood all of the terms of this agreement, am agreeing to the terms of this agreement and voluntarily giving up substantial legal rights, including the right to sue.
